Enhanced DBS Checks For Healthcare Workers

Most people working in health care within the NHS must have an Enhanced DBS check with the barring list checked for the appropriate groups. For example, a paediatric nurse would require both an Enhanced DBS check with a children’s barring list check. However, a doctor working with all groups would require an Enhanced DBS check with a child and adult barring list check.

An Enhanced DBS check is the most in-depth criminal record check and discloses all spent and unspent convictions, cautions, reprimands and warnings.

Who needs a DBS check in health Care?

An Enhanced DBS’s eligibility criteria would need to be confirmed based on the defined job specification and responsibilities. The work environment and time spent in direct contact with any vulnerable person would also need to be considered.

DBS Checks For Health Care Workers 

Any health care professional who provides personal care to a vulnerable adult or child is legally required to have an Enhanced DBS check carried out. Health care is classified as a ‘regulated’ activity and requires the highest level background check.

DBS Checks For Health Care Support Workers

Persons working within the NHS who have incidental contact with patients, such as maintenance, admin, domestic and catering staff would be eligible for a Standard level DBS check. This level of check does not cover the adults or child barring lists.

DBS Check For Health Care Volunteers

A volunteer is a person engaged in an activity that involves spending time unpaid (except out-of-pocket expenses) doing activities to benefit an individual or group. 

Volunteer eligibility is only applicable if the applicant is not benefiting from the work they are carrying out. For example, an individual on a course that requires them to volunteer, undertake work experience or work in a trainee position that will transition into a full-time role or qualification would not be eligible for the volunteer rate application. 

Most volunteers will require an Enhanced check, but eligibility for barring lists checks will depend on whether the volunteer would be unsupervised or not.

In a word, yes. While DBS checks, in general, are not a legal requirement, because health care is a regulated activity, employers are legally obliged to carry out relevant checks.

How often DBS checks are updated for roles within the NHS vary depending on location and risk factors and there is no legal requirement to carry out periodic checks. With that said, it is common for checks to be updated within the NHS every three years. This is because a DBS check is only relevant up until the moment the certificate was issued.

Employers must treat everyone fairly regardless of background. An employer will need to decide whether an applicant’s past record will impact the ability to carry out a role and keep everyone safe. For example, if your crime was against a child and the position applied for puts the applicant in direct contact with children, it would be reasonable not to offer that person the job.
